Jack Smith Tracked Calls and Private Communications of Several GOP Senators Amid Arctic Frost Probe, Doc Shows

Former special counsel Jack Smith’s probe into 2020 election interference collected phone metadata of almost a dozen Republican lawmakers, an internal FBI document reveals.

In a document released Monday by the FBI exposing the agency’s sprawling “Arctic Frost” probe of Jan. 6 under Joe Biden, Smith’s probe is reported to have swept up the cell phone communications of numerous Republican senators, including Sens. Mike Kelly (R-Pa.), Lindsey Graham (R-S.C.), Bill Hagerty (R-Tenn.), Josh Hawley (R-Mo.), Dan Sullivan (R-Alaska), Tommy Tuberville (R-Ala.), Ron Johnson (R-Wis.), Cynthia Lumis (R-Wyo.), and Marsha Blackburn (R-Tenn.).

The document, dated Sept. 27, 2023, features redactions of the FBI agents involved in the probe and shows the FBI’s Cellular Analysis Survey Team (CAST team) was tapped to carry out the investigation.

The probe’s case ID also shows the investigation was dubbed, “ARCTIC FROST—Election Law Matters—SENSITIVE INVESTIGATIVE MATTER—CAST.”

“FBI Special Agent [redacted] conducted preliminary toll analysis on limited tolls records associated with the following US Senators,” the document states, going on to list out the aforementioned lawmakers.

According to Fox News, the CAST team was able to track which phone numbers the senators called, the location from which the phone calls originated and the location where they were received, with sources telling Fox the calls likely had to do with certification of the 2020 election.

Smith and investigators reportedly subpoenaed phone providers to obtain the records, a source told Fox.

The document came to light following an oversight request by Sen. Chuck Grassley (R-Iowa), who wrote on X Monday, “This document shows the Biden FBI spied on 8 of my Republican Senate colleagues during its Arctic Frost investigation into ‘election conspiracy’ Arctic Frost later became Jack Smith’s elector case against Trump.”

“BIDEN FBI WEAPONIZATION = WORSE THAN WATERGATE,” he added.

FBI Deputy Director Dan Bongino reportedly briefed the affected senators Monday, later telling Fox News, “It is a disgrace that I have to stand on Capitol Hill and reveal this — that the FBI was once weaponized to track the private communications of U.S. lawmakers for political purposes…That era is over.”

“Under our leadership, the FBI will never again be used as a political weapon against the American people,” Bongino stated.

Likewise, FBI Director Kash Patel similarly criticized the probe, writing, “We recently uncovered proof that phone records of U.S. lawmakers were seized for political purposes. That abuse of power ends now.”


“Under my leadership, the FBI will deliver truth and accountability, and never again be weaponized against the American people,” he added.

“Arctic Frost” was launched by the FBI in April 2022 and looked at then-former President Trump’s alleged efforts to overturn the 2020 election, including a probe of the events of Jan. 6.

Later that year in November, Biden Attorney General Merrick Garland appointed Special Counsel Jack Smith to oversee the DOJ’s various investigations into Trump, which included Arctic Frost and the probe into Trump’s handling of classified documents found at Mar-a-Lago.

After Trump won the 2024 election, Smith petitioned Judge Tanya Chutkan to dismiss the case, which she granted.

Fox News notes, “Smith’s case cost taxpayers more than $50 million.”
